PURE COLLECTIVES

By participating in any Pure Collectives project, event, publication, collaboration, or by accessing this website, the Participant acknowledges that they have read, understood, and agree to be bound by the following Terms & Conditions.

Grant of Rights
The Participant irrevocably grants Pure Collectives, Pure Collectives Magazine, Faschun Jinkz, and their approved partners, sponsors, collaborators, affiliates, successors, licensees, and assigns a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable right to photograph, film, record, edit, reproduce, publish, display, distribute, transmit, archive, promote, advertise, and otherwise use the Participant's name, image, likeness, voice, performance,  and all content created in connection with Pure Collectives.

These rights extend to all forms of media now known or hereafter developed, including but not limited to printed publications, magazines, books, editorials, websites, social media platforms, promotional campaigns, advertisements, exhibitions, presentations, documentaries, educational materials, digital publications, portfolios, marketing materials, and archival records.
Content lawfully published, distributed, or released by Pure Collectives or its approved partners may continue to exist indefinitely in magazines, websites, social media platforms, promotional materials, portfolios, archives, and any other previously published medium without constituting a breach of this Agreement.

Creative & Editorial Control
The Participant acknowledges that Pure Collectives, Pure Collectives Magazine, Faschun Jinkz, and their approved partners shall retain sole and absolute discretion over all creative, artistic, editorial, production, marketing, and publication decisions, including but not limited to the selection, editing, cropping, retouching, colour grading, sequencing, captions, layouts, graphic design, publication, advertising, distribution, and presentation of all content.
The Participant shall have no right to control, alter, approve, reject, or require modifications to the final published content.

Participant Restrictions
The Participant shall not publish, distribute, reproduce, edit, license, sell, or otherwise commercially exploit any unpublished or exclusive content created through Pure Collectives without the Company's prior written consent.
Nothing contained herein prevents the Participant from sharing content that has already been officially approved/released by Pure Collectives, provided such use does not imply ownership, endorsement, or authorization beyond that expressly granted.

Intellectual Property
Unless otherwise agreed in writing, all photographs, videos, audio recordings, publications, magazine layouts, graphic designs, branding, marketing materials, and other creative works produced by or on behalf of Pure Collectives shall remain the exclusive intellectual property of Pure Collectives, Pure Collectives Magazine, Faschun Jinkz, or the respective copyright owner.
Participants retain ownership only of intellectual property that existed prior to their participation and which is independently owned by them.

Payments
Certain opportunities may be  either a complimentary or paid basis. Optional production contributions, premium participation packages, editorial upgrades, and other services shall be communicated prior to confirmation.
Unless otherwise agreed in writing, all payments are non-refundable once production, editorial work, event preparation, or related services have commenced. 

Conduct
All Participants agree to conduct themselves professionally, respectfully, and lawfully throughout every production, event, communication, and collaboration associated with Pure Collectives.
Pure Collectives reserves the right to suspend, remove, or terminate any Participant whose conduct is deemed unsafe, abusive, discriminatory, unlawful, disruptive, or otherwise inconsistent with the values and objectives of the organization.

Release & Limitation of Liability
The Participant releases and forever discharges Pure Collectives, Pure Collectives Magazine, Faschun Jinkz, their approved partners, sponsors, affiliates, directors, employees, volunteers, contractors, photographers, videographers, agents, representatives, successors, and assigns from any and all claims, demands, liabilities, damages, costs, or causes of action arising from or relating to the lawful creation, publication, distribution, promotion, or authorized use of the content.
This release includes, but is not limited to, claims relating to rights of publicity, invasion of privacy, defamation, emotional distress, misappropriation of likeness, copyright disputes arising from authorized use, and commercial exploitation conducted in accordance with this Agreement.
This release shall not apply to any use that exceeds the rights granted under this Agreement or otherwise violates applicable law.

Privacy
Pure Collectives may collect and process personal information for the purposes of administering registrations, communicating with participants, publishing content, marketing projects, organizing events, improving services, and complying with legal obligations. Personal information will be handled in accordance with applicable privacy laws.

Amendments
Pure Collectives reserves the right to amend these Terms & Conditions at any time. Continued participation, use of the website, or engagement with any Pure Collectives project following such amendments shall constitute acceptance of the revised Terms.

Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the applicable laws of Canada. Any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, unless otherwise required by applicable law.
